16.Mar.2011 Landlord’s Right to Remove Tenant’s Personal Property

Landlords, also known as “Lessors,” are permitted to remove a tenant’s (or Lessee’s) personal property from a leased premises if that property has been established to be abandoned. Determining whether personal property left behind by a tenant is abandoned is usually very difficult. The best course of action for a landlord is to include language in the lease agreement regarding what happens to property left behind by the tenant at the expiration of the lease term. If property IS deemed to be abandoned, a landlord has the right to enter the premises without a dispossessory action and remove the personal property.

Beginning with Section 44-7-50, the Official Code of Georgia (O.C.G.A.) sets forth the procedure landlords/lessors must follow in order to evict a tenant/lessee.  Failure to follow the steps codified in these sections may subject a landlord/lessor to civil liability, including punitive damages.
